Drafting Motions & Orders /Clear the Clutter: How to Get and Stay Organized

Drafting Motions & Orders
Moderator: Kent E. Altom, The Gilroy Firm
Nicole C. Leet, Gray, Rust, St. Amand, Moffett & Brieske, LLP
Tracey Ledbetter, Eversheds Sutherland (US) LLP

A motion can move a court case forward. An Order should encapsulate what action has occurred during the case. It is imperative that your motions and proposed Orders are characterized by accuracy, brevity, and clarity. Generally speaking, in life, you often “have not because you ask not.”  Before filing a motion, you must have a clear understanding of what you are asking the court to do for your client. Then, you must ask the court to do it, providing the court with justification for doing what you have asked. In proposing an Order, you must strike the balance between “too little” and “too much.”  You need it to say everything you need even if it does not say everything you want.  In this session, you will learn how to draft motions that will be granted and proposed Orders that will be entered.

This framework and its details provide a basis for thinking about and implementing individual change(s) to move away from a position of just surviving (or even abandoning) to thriving in your legal practice.
